Terms of Service

1. Acceptance of these terms

These Terms of Service ("Terms") govern your access to and use of Surnuaiapüha (the "Service"). By creating an account, using the Service, or ticking the agreement boxes before a payment, you agree to be bound by these Terms and to our Privacy Policy. Each agreement is recorded with its version, the date and time and a receipt number. If you do not agree, please do not use the Service.

2. Who we are

3. The Service

Surnuaiapüha lets you create permanent memorial Profiles: a life story, photographs, grave details and a map pin to the grave, an optional QR sticker for the grave marker, a shared documents store for your Account, and the ability to invite family and friends to help. Profiles are private until you choose to publish them, and you can schedule a future date on which a Profile becomes public.

4. Eligibility and your account

You must be at least 18 years old. Keep your password confidential; you are responsible for everything done through your Account, including by people you invite. Tell us immediately if you think someone else has access to it.

5. Prices and payments

All prices are in euro and include any applicable VAT. Payments are one-off — there is no subscription and nothing renews automatically.

• Your first Profile is free to build for 30 days.
• €10 makes a Profile permanent and public, and includes 1,000 words and 5 photographs.
• Each further €10 adds another 1,000 words and 5 photographs to that Profile, up to a maximum of €100, which gives 10,000 words and 47 photographs.
• Each additional Profile is charged from €10 in the same way.
• €100 activates the 10 GB Account documents store once for your whole Account, and any Profile you own can then link to those documents.
• QR stickers and gifts are priced as shown at the time of ordering.

We accept cards, SEPA Direct Debit and euro bank transfers through Stripe. With bank transfer and SEPA Direct Debit, allowances are credited once the money actually settles. Amounts are not transferable between Profiles or Accounts unless the transfer is a gift bought through the gift page.

6. Right of withdrawal, refunds and reversals

If you are a consumer in the European Union you normally have 14 days to withdraw from a purchase of digital content. Because a Profile is published and its allowances become usable immediately, you are asked to confirm at checkout that you want us to start straight away and that you accept losing the right of withdrawal once we have. If you have not yet used what you paid for, write to us within 14 days and we will refund you.

If a payment is later reversed — for example a SEPA Direct Debit is returned or a card payment is charged back — the allowances that payment bought are removed. Where a Profile then falls below the €10 minimum it is unpublished until the balance is settled, and we email you before this happens. We may recover reasonable costs charged to us by the payment provider for a reversal.

7. Your content and the licence you grant us

You keep ownership of everything you upload. You grant us a worldwide, royalty-free licence to store, copy, adapt for display, and — where you have made a Profile public — publish that content, solely in order to run the Service. The licence ends when you delete the content, except for copies already held in backups for a limited period.

You confirm that you have the right to upload each photograph, document and text, and that publishing it does not breach anyone's rights.

7A. Optional permission for research, books, films and AI use

Publishing a Profile makes it readable by anyone. It does not, by itself, allow the material to be used for anything else. Separately and only if you choose to, you may give a further permission for each Profile, from the Profile editor, allowing the public material on that Profile to be referenced for research, education, books, documentaries, films, AI analysis and other commercial projects.

This permission is off by default. Giving it grants a non-exclusive, worldwide, royalty-free right to quote, reproduce, analyse and adapt the public material of that Profile for those purposes, with attribution as you choose when you give it: your full name, family name only, or anonymously. It never transfers ownership, and it never covers content you have kept private, unpublished, or scheduled for a future date.

When you give this permission you confirm that you own the material or have permission from the person who does. Photographs or text you flag as belonging to someone else — in the Profile's "material you do not own" note, or by ticking an individual photograph — are excluded from every use under this section.

You may withdraw this permission at any time from the same place, and it is withdrawn automatically if the Profile is made private or unpublished. Withdrawal takes effect immediately for all future use. Work lawfully published by a third party before the withdrawal cannot be recalled. We record the date and the wording version of every grant and withdrawal.

Do not include sensitive information in a published Profile: private details of living people, medical or financial information, home addresses, identity numbers, or anything told to you in confidence.

8. Living people and personal identity codes

Family tree entries and documents can hold information about living relatives, including personal identity codes. You may only add such details where you have the person's agreement or another lawful reason, and you must not publish a living person's identity code, health information or address without their clear consent. A person can ask us to review content about them by emailing support@balticmemorials.com; we will contact the Account Holder and may hide or remove the information while the request is considered.

9. Collaborators

You may invite others to help with named Profiles. A contributor may write the life story, add grave details, family tree entries and photographs; only you as Account Holder can pay, publish, order QR stickers, manage sharing or delete a Profile. Everyone you invite must accept the Collaborator Agreement before their access begins. An unused invitation expires after 90 days, and accepted access lapses after 90 days without activity; you can re-invite at any time. You remain responsible for what your collaborators add.

10. Gifts

You can buy Profile credit as a gift without holding an Account. The recipient redeems it by confirming a code sent to their email address, and may apply it to an Account held under a different email address. Unredeemed gifts stay valid for 12 months from purchase. Gift purchases are subject to the same agreement, withdrawal and reversal rules as any other payment.

11. Acceptable use

Do not upload unlawful, abusive, discriminatory or deliberately false content; do not create a Profile for a person you have no connection with in order to harass their family; do not scrape, bulk-download or resell Profile content; do not attempt to break the Service's security or to bypass the checks on document downloads.

12. Suspension and termination

We may suspend or remove content or an Account that breaches these Terms or the law, normally after warning you. You can close your Account at any time. Where an Account is closed we keep payment records for the period the law requires, as set out in the Privacy Policy.

13. Availability, disclaimers and liability

We work hard to keep memorials online permanently and to keep backups, but we cannot guarantee uninterrupted service. Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law, and nothing affects the statutory rights of consumers. Subject to that, our total liability for any claim is limited to the amount you have paid us in the 12 months before the claim.

Surnuaiapüha is not operated as a profit-motivated commercial enterprise and does not offer or undertake to meet service-level agreements. The project is not staffed on the basis of regular attendance. Support is provided by email when capacity permits, without a guaranteed response, resolution or delivery time.

Administration is increasingly automated in order to reduce human involvement towards zero, and approximately 95% of problem-solving is performed with artificial intelligence. Unless these Terms expressly say otherwise or the law requires a deadline, no contractual deadline applies to support, administration, corrections or other project work.

Legal and financial compliance work, and the continuing fulfilment of obligations to people who have paid for services, may therefore proceed very slowly as capacity permits. This does not remove any obligation we have accepted, alter any express paid entitlement, extend a deadline imposed by law, or limit any mandatory consumer right or legal remedy.

14. Changes to the Service and these Terms

We may update these Terms; the new version number is published here and you are asked to agree to it the next time you pay. Material changes are also announced by email. If you do not agree to a new version you can stop using the Service, and content you have already paid to publish stays online.

15. Governing law, disputes and contact

These Terms are governed by the laws of England and Wales, and disputes are heard by the courts of England and Wales. If you are a consumer resident in the European Union, you keep the protection of the mandatory consumer law of your own country and may bring proceedings there. Consumers can also use the European Commission's online dispute resolution platform.
